11 - Supplemental Notice to Residents of California, Virginia, Colorado, Connecticut, Utah, Nevada and Other U.S. States in Which an Applicable Privacy Law is in Effect
11.1 Introduction.
In this section, we provide information for residents of California, Virginia, Colorado, Connecticut, Utah, Nevada, and such other U.S. states in which an applicable privacy or data protection law is in effect from time to time, as may be required under the applicable privacy or data protection laws of such states in effect from time to time (“State Privacy Laws”). For instance, the California Consumer Privacy Act (“CCPA”), as amended by the California Consumer Privacy Rights Act (“CPRA”), and the Virginia Consumer Data Protection Act (“VCDPA”), require that we provide their respective residents certain specific information about how we handle their personal information. Because certain State Privacy Laws require that we disclose specific information about how we handle certain personal information collected about residents of their states, the scope of this section may be different than the scope of the rest of our Privacy Notice.
11.2 Definitions of key terms.
Under State Privacy Laws, subject to certain exceptions, “Personal Information” is generally any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular resident or household in the applicable state.
A “Sale” of Personal Information under State Privacy Laws such as CCPA and VCDPA may occur any time a business sells or makes available any Personal Information to a third party for monetary or other valuable consideration.
A “Share” of Personal Information under the CPRA generally means disclosing, making available or communicating Personal Information by a business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.
“Cross-context behavioral advertising” means the targeting of advertising to a consumer based on the consumer’s Personal Information obtained from the consumer’s activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.
“Sensitive personal information” under State Privacy Laws is generally defined as Personal Information that reveals sensitive information about a consumer, such as social security, driver’s license, state identification card or passport numbers, account log-in, financial account, debit card or credit card numbers in combination with any required security or access code, password or credentials allowing access to an account, precise geolocation, data revealing racial or ethnic origin, religious beliefs, physical or mental health diagnosis, sexual orientation, or citizen or immigrant status, as well as processing of genetic or biometric data for identification, and personal data collected from a known child.
11.3 Rights under State Privacy Laws.
Depending on where you reside, you may have additional legal rights with respect to your information under State Privacy Laws, beyond those described under Section 7 (Your Choices) above. These rights are described below. While some of these rights apply generally, certain rights apply in limited cases. Consistent with State Privacy Laws, this Supplemental Notice provides information about how to exercise such rights for residents of the above states. This section does not apply to any matters exempted from State Privacy Laws during the period of exemption, nor to matters covered by an applicable law prior to the relevant portion of the applicable State Privacy Laws going into effect.
Right to Know
You may have the right, depending on your jurisdiction, to request the following about the Personal Information we have collected about you during the past 12 months or other required time period*:
Provide and deliver products and services and related communications, communicate with you within the context of our business relationship, and for billing and invoicing purposes.
The categories and specific pieces of Personal Information we have collected about you;
The categories of sources from which we collected the Personal Information;
The business or commercial purpose for which we collected the Personal Information;
The categories of third parties to whom we Sold or with whom we Shared the Personal Information;
The categories of Personal Information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose;
The specific pieces of Personal Information about you that we collected, disclosed to third parties for a business purposes, Sold to and/or (if you reside in California) Shared with, third parties;
The right to receive requested information in a readily-usable format if provided electronically;

11 - Supplemental Notice to Residents of California, Virginia, Colorado, Connecticut, Utah, Nevada and Other U.S. States in Which an Applicable Privacy Law is in Effect
11.1 Introduction.
In this section, we provide information for residents of California, Virginia, Colorado, Connecticut, Utah, Nevada, and such other U.S. states in which an applicable privacy or data protection law is in effect from time to time, as may be required under the applicable privacy or data protection laws of such states in effect from time to time (“State Privacy Laws”). For instance, the California Consumer Privacy Act (“CCPA”), as amended by the California Consumer Privacy Rights Act (“CPRA”), and the Virginia Consumer Data Protection Act (“VCDPA”), require that we provide their respective residents certain specific information about how we handle their personal information. Because certain State Privacy Laws require that we disclose specific information about how we handle certain personal information collected about residents of their states, the scope of this section may be different than the scope of the rest of our Privacy Notice.
11.2 Definitions of key terms.
Under State Privacy Laws, subject to certain exceptions, “Personal Information” is generally any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular resident or household in the applicable state.
A “Sale” of Personal Information under State Privacy Laws such as CCPA and VCDPA may occur any time a business sells or makes available any Personal Information to a third party for monetary or other valuable consideration.
A “Share” of Personal Information under the CPRA generally means disclosing, making available or communicating Personal Information by a business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.
“Cross-context behavioral advertising” means the targeting of advertising to a consumer based on the consumer’s Personal Information obtained from the consumer’s activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.
“Sensitive personal information” under State Privacy Laws is generally defined as Personal Information that reveals sensitive information about a consumer, such as social security, driver’s license, state identification card or passport numbers, account log-in, financial account, debit card or credit card numbers in combination with any required security or access code, password or credentials allowing access to an account, precise geolocation, data revealing racial or ethnic origin, religious beliefs, physical or mental health diagnosis, sexual orientation, or citizen or immigrant status, as well as processing of genetic or biometric data for identification, and personal data collected from a known child.
11.3 Rights under State Privacy Laws.
Depending on where you reside, you may have additional legal rights with respect to your information under State Privacy Laws, beyond those described under Section 7 (Your Choices) above. These rights are described below. While some of these rights apply generally, certain rights apply in limited cases. Consistent with State Privacy Laws, this Supplemental Notice provides information about how to exercise such rights for residents of the above states. This section does not apply to any matters exempted from State Privacy Laws during the period of exemption, nor to matters covered by an applicable law prior to the relevant portion of the applicable State Privacy Laws going into effect.
Right to Know
You may have the right, depending on your jurisdiction, to request the following about the Personal Information we have collected about you during the past 12 months or other required time period*:
Provide and deliver products and services and related communications, communicate with you within the context of our business relationship, and for billing and invoicing purposes.

While Predactiv does not “sell” business contact information or data collected via our Site in the traditional sense of the word, in cases where we transfer Personal Information to third parties such as marketing partners, or in cases where or enable third parties to collect Personal Information from the Site (such as where third party tracking technologies are placed on the Site), this may constitute a “Sale” under certain State Privacy Laws (and/or a Sharing, with respect to Personal Information of California residents). 12 - European Union, Switzerland and UK Data Subjects’ Privacy Rights
12.1 Individual rights.
If you are located in the European Economic Area (EEA), the General Data Protection Regulation (GDPR) applies to our processing of your Personal Data. If you are located in Switzerland, The Swiss Federal Data Protection Act applies to our processing of Personal Data. If you are located in the United Kingdom, then the Data Protection Act 2018 applies to our processing of personal data (the foregoing laws in this sub-section, collectively, “EU Data Protection Laws”). To the extent information we collect is associated with an identified or identifiable natural person and is protected as personal data under EU Data Protection Laws, it is referred to in this Privacy Notice as “Personal Data”. These laws each grant those located respectively in the EEA, Switzerland, and the UK a set of clear privacy rights and imposes responsibilities on Predactiv as we process the Personal Data of data subjects located in those places (“EEA Data Subjects”). We will endeavor to respond to any requests to exercise your rights within one month from when they are made, although this period may be extended in some cases in which case we will inform you before the expiration of the one-month period. 12.3 Cross-border transfers of EEA, Swiss and UK Personal Data:
We generally process data in the United States. When we share data through our Data Solutions, we provide data to companies globally. In each case, we have safeguards in place which allow those transfers to happen in a way that ensures data is handled in accordance with the applicable law. When we transfer Personal Data outside the EEA, Switzerland or UK, unless the recipient or location to which the data is transferred has been approved by the appropriate authorities as providing an adequate level of protection for personal data, we put in place measures to ensure that the transfer complies with the applicable EU Data Protection Law and that the Personal Data which is transferred is appropriately safeguarded. When we enter into business relationships which involves the transfer of Personal Data of EEA data subjects to the United States, we put in place reasonable transfer mechanisms, such as the EU standard contractual clauses with the recipient. 12.5 Legal Bases For Processing Personal Data.
We may process your Personal Data under applicable EU Data Protection Law on the following legal grounds:
Contractual Necessity: we may process your Personal Data to enter into or perform a contract with you.
Consent: where you have provided consent to process your Personal Data. You may withdraw your consent at any time.
Legitimate interest: we process your Personal Data to provide our Site to you, such as to provide our online user experience, communicate with you, provide customer service, market, analyze, operate and improve our business, and to protect our Site.
Where processing is necessary to comply with our legal obligations.
12.6 Onward Transfer/Data Privacy Framework.
Predactiv has certified that it adheres to the EU-U.S. Data Privacy Framework (DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF program principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. In the context of an onward transfer, Predactiv is responsible for the processing of personal data it receives under the DPF and subsequently transfers to a third party acting as an agent on its behalf. Predactiv shall remain liable under the DPF principles if its agent processes such personal data in a manner inconsistent with the DPF principles, unless the Predactiv proves that it is not responsible for the event giving rise to the damage.
In compliance with the EU-U.S. Data Privacy Framework (DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Predactiv commits to resolve complaints about your privacy and our collecting or use of your personal information. European Union, UK, or Swiss individuals with inquiries or complaints regarding this privacy notice should first contact Predactiv directly at privacy@predactiv.com. We will respond to your complaint within 30 days of receipt.
For complaints that cannot be resolved between Predactiv and the individual concerned, Predactiv has further committed to refer unresolved privacy complaints under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to the BBB Data Privacy Framework Program, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. Should your complaint remain fully or partially unresolved after a review by Predactiv, BBB Data Privacy Framework Program and the relevant DPA, you may be able to, under certain conditions, seek binding arbitration before the Data Privacy Framework Panel. The Federal Trade Commission has investigation and enforcement authority over our compliance with the Data Privacy Framework.
